1. Welcome to ISAMAA ("Service"). By using this Service, you agree to be bound by all of the terms of this Agreement and by our Commenting Guidelines. The Service is currently free to all users. We reserve the right to change the terms of this Agreement or to modify any features of this Service at any time. By registering for this Service and/or continuing to use this Service after the posting of Notices regarding such changes, you agree to be bound by such changes
2. You represent that you have read and agree to abide by the following Samaa.tv Commenting Guidelines: Samaa welcomes user comments on our stories and posts. Samaa's mission is to engage the public in news analysis of issues in their community and to encourage interaction with our editors, writers and other posters. We intend for this area to be used by our readers as a place for civil, thought-provoking and high-quality public discussion. In order to achieve this, Samaa requires that all users making comments register and post comments with their actual names and place of residence. Samaa reserves the right to remove postings that include the use of foul language, personal attacks or the use of language that may be libelous or interpreted as inciting hate or sexual harassment; however we are under no obligation to do so. User comments may be reviewed by moderators and may be included or excluded at our discretion.

   By posting messages, uploading files, inputting data, or engaging in any other form of communication through this Service, you grant us a royalty-free, perpetual, non-exclusive, unrestricted, worldwide license to use, reproduce, modify, adapt, translate, enhance, transmit, distribute, publicly perform, display, or sublicense any such communication (including your identity and information about you) in any medium (now in existence or hereinafter developed) and for any purpose, including commercial purposes, and to authorize others to do so.

This Service (including, but not limited to, text, photographs, graphics, video and audio content) is protected by copyright as a collective work or compilation under the copyright laws of Islamic Republic of Pakistan and other countries. All individual articles, content and other elements comprising this Service are also copyrighted works. You must abide by all additional copyright notices or restrictions contained in this Service.
4. 1. Except for content you have posted on the Service, or unless expressly permitted, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of this Service, except that you may download material from this Service for your own personal use as follows: you may make one machine readable copy and/or one print copy that is limited to occasional articles of personal interest only. Without limiting the generality of the foregoing, you may not distribute any part of this Service over any network, including a local area network, nor sell or offer it for sale. In addition, these files may not be used to construct any kind of database.
   2. Samaa.tv has been specially designed for presentation of content in a unique format and appearance to our users. We are concerned about the integrity of our Service when it is viewed in a setting created by a third party that includes advertising or other materials that we have not authorized to be displayed with our Service. Without limiting the provisions of (5a), neither you nor any third party shall make use of the contents of the Service in any manner that constitutes an infringement of our rights, including copyright that has not been authorized by us.
   3. Just as Samaa.tv requires users to respect our copyrights, and those of our affiliates and partners, we respect the copyrights of others. If you believe in good faith that your copyrighted work has been reproduced on our site without authorization in a way that constitutes copyright infringement, you may notify Samaa.tv.
5. Samaa.tv does not currently charge for its Service. If Samaa.tv does initiate a charge for its Service, notification of such charges will be posted on our home page. You will be responsible for all charges, if any, incurred while your account is being used, including charges for any goods or services. You are also responsible for all statements made or materials posted under your account, including liability for harm caused by such statements or materials. You may not transfer, sell, or otherwise assign your rights or obligations under this Agreement.

You agree to indemnify and hold harmless Samaa.tv and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement or the Samaa.tv Service Commenting Guidelines, or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide us with such cooperation as is reasonably requested by us.
7. This Service is available "as is." We do not warrant that this Service will be uninterrupted or error-free. There may be delays, omissions, interruptions and inaccuracies in the news, information or other materials available through this Service. We are not responsible for the availability or content of other services that may be linked to this Service. We do not make any warranties, express or implied, including without limitation, those of merchantability and fitness for a particular purpose, with respect to this Service or any information or goods that are available or advertised or sold through this Service. We do not make any representations, nor do we endorse the accuracy, completeness, timeliness or reliability of any advice, opinion, statement or other material or database displayed, uploaded or distributed in this Service or available though links in this Service. We reserve the right to correct any errors or omissions in this Service but are under no obligation to do so. We do not guarantee or warrant that this Service or materials that may be downloaded from this Service do not contain viruses, worms or other destructive features. We are not liable for any damages or harm attributable to such features. If you rely on this Service and any materials available through this Service, you do so solely at your own risk.
8. Samaa.tv AND ITS PARENT AND AFILLIATES, AND THEIR DIRECTORS, OFFICERS, MANAGERS, EMPLOYEES, DONORS, AGENTS AND LICENSORS ARE NOT LIABLE FOR INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING LOST REVENUES OR PROFITS, LOSS OF BUSINESS OR LOSS OF DATA, IN ANY WAY RELATED TO THIS SERVICE OR FOR ANY CLAIM, LOSS OR INJURY BASED ON ERRORS, OMISSIONS, INTERRUPTIONS OR OTHER INACCURACIES IN THIS SERVICE (INCLUDING WITHOUT LIMITATION AS A RESULT OF BREACH OF ANY WARRANTY OR OTHER TERM OF THIS AGREEMENT).
9. This Agreement may be terminated by either party for any reason at any time. Sections three (3) and six (6) through nine (9) of this Agreement shall survive such termination.
10. This Agreement shall be governed by the laws of the Islamic Republic of Pakistan. Any action to enforce this Agreement shall be brought in the federal or provincial courts. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
11. No Waiver of Terms: Samaa’s failure to exercise or enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision in that or any other instance.
12. Modifications: Samaa reserves the right to change, at any time, at our sole discretion, the Terms under which these Services are offered. You are responsible for regularly reviewing these Terms. Your continued use of the Services constitutes your agreement to all such Terms.
13. Termination of Service: Samaa disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Services or any software provided through the Services. Samaa reserves the right to modify, suspend, or discontinue the Services or access to the Services without any notice at any time and without any liability to you.
14. Extent of Terms: The Terms apply to use of and contribution to the Samaa website and any account provided therefore. Samaa may operate additional projects or services which require separate or additional terms. Such different terms are made available through the individual project or service and are not addressed further herein.

Account

• Registration

  To utilize the Services, or certain portions thereof, you may be required to complete a registration process and establish an account with Samaa ("Samaa Account"). You represent and warrant that all information provided by you to Samaa is current, accurate, and complete, and that you will maintain the accuracy and completeness of this information on a prompt, timely basis.

• Password and Security

  As a registered user of Samaa Services, you may receive or establish one or more passwords. You are solely responsible for maintaining the confidentiality and security of your password(s) and Samaa Account(s). You understand and agree that you a fully responsible for all actions and postings made from your Samaa Account(s). Any accounts you are create are not transferrable. You agree to notify Samaa immediately if you become aware of any unauthorized use of your Samaa Account(s).

• Termination

  Samaa reserves the right to terminate your Samaa Account or restrict access to your Samaa Account, or to delete any content posted through your Samaa Account, with or without notice, for any or for no reason, and without any liability to you.

Community Participation/Citizen Journalism

• Browsing

  You understand that material made available on the Citizen Journalism Service is a product of a community effort and does not necessarily represent the views of Samaa. Samaa assumes no responsibility for the accuracy, suitability, or completeness of any content provided as part of the Citizen Journalism service.

• Linking

  You understand that Samaa has not and cannot review all material made available through websites linked or linking to any part of this site. You also understand that no such linking implies in any way that Samaa endorses or is affiliated with any third-party website. You agree that Samaa bears no responsibility or liability for any content accessed or harm caused from any third-party website.

• Attribution-Noncommercial-Share Alike License

  Except where otherwise noted, any and all content contributed by you to the Services or this website is submitted under a Creative Commons Attribution-Noncommercial-Share Like 3.0 License.

• Samaa License

  By posting or contributing content using these Services, you are granting Samaa a non-exclusive, royalty-free, perpetual, and worldwide license to use your content in connection with the operation of the Services, including, without limitation, the license rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your content, and/or to incorporate it into a collective work.

• Content

  Contributed content should be relevant to the subject scope of Samaa. Content may not be illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or otherwise injurious or objectionable.

  Samaa does not pre-screen or regularly review any contributed content, but Samaa has the right (though not the obligation) to remove, without notice, any content posted which Samaa considers, for any reason, to violate these Terms or to be outside the subject scope of the Services. Samaa may terminate any account, with or without notice, for posting such content.

• User Representations and Warranties

  By posting any content, you represent and warrant that you have all right, title, and interest to such posted content, including but not limited to any consent, authorization, release, clearance or license from any third party (such as, but not limited to, any release related to rights of privacy or publicity) necessary for you to provide, post, upload, input or submit the content, and that posting such content does not violate or constitute the infringement of any patent, copyright, trademark, trade secret, right of privacy, right of publicity, moral rights, or other intellectual property right recognized by any applicable jurisdiction of any person or entity, or otherwise constitute the breach of any agreement with any other person or entity. Other Terms

• Governing Law and Entire Agreement

  These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to the rules of conflict of law that may cause the laws of another jurisdiction to apply. You agree to the sole and exclusive jurisdiction and venue of the federal or state courts of the Islamic Republic of Pakistan in the event of any dispute of any kind arising from or relating to the Site, or your use or review of it. The Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms to be unenforceable, the remainder of the Terms will continue in full force and effect.
